The role of the Licensing Committee
The role of the Licensing Committee is to exercise the Council’s Licensing, registration and other miscellaneous functions as specified in Schedule 1 of the Local Authorities (Functions and Responsibilities) (England) Regulations, 2000 and any subsequent Regulations modifying or replacing those Regulations, insofar as such functions are not the responsibility of any other local authority.
To exercise all the Council’s powers under the Licensing Act 2003 and any related legislation, with the exception of determining the Licensing Policy as set out in section 5(2) of the Act.
To exercise the powers conferred upon the Licensing Committee by the Gambling Act 2005 and any related legislation.
To establish a Licensing and Gambling Acts Sub-Committee.
To make Orders prohibiting the consumption of alcohol in designated public places under the Criminal Justice and Police Act, 2001.
To consider any matter referred to the Committee by the Council, another Committee, the Cabinet or a Cabinet Member which relates to functions for which the Committee is responsible.
To determine applications for sexual entertainment venue licences, formulate a policy, set fees and standard conditions and all of the Council’s other functions arising from the adoption of Schedule 3 of the Local Government (Miscellaneous Provisions) Act 1982, as amended.
To exercise all the Licensing functions under the Scrap Metal Dealers Act 2013.
