To approve the proposed modifications to the Vale of Aylesbury Local Plan which respond to issues that have arisen during the examination.
The proposed modifications consist of 'main modifications' (which materially affect the Plan's policies) and 'additional modifications' (which are of a more minor nature: for example, to correct typographical errors or make consequential changes).
Following the Council's request under section 20(7C) of the Planning and Compulsory Purchase Act 2004 for the Inspector to recommend main modifications as necessary to make the Plan sound and legally-compliant (letter dated 7 September 2018), the Council has prepared a comprehensive list of proposed modifications.
The proposed modifications respond to issues raised during the examination including the Inspector's questions, discussion documents, actions identified during the hearing sessions, the Inspector's interim findings and subsequent correspondence.
The modifications are based on updated evidence where appropriate including an Addendum to the Sustainability Appraisal. They consist of 'main' and 'additional' modifications as explained above.
The modifications must be approved under agreed delegation arrangements before they can be sent to the Inspector and published.
The modifications will be sent to the Inspector for his consideration to ensure he is reasonably satisfied that the main modifications are necessary to rectify the unsoundness problems that have already been identified in the examination so far.
Once the Inspector is reasonably satisfied, the main modifications will be published by the Council for six weeks public consultation to give the opportunity to comment.
To not approve the proposed modifications, which would mean that the Vale of Aylesbury Local Plan could not progress further and would have to be withdrawn.
