To grant a Sitting Out Licence to Nando’s Chickenland Limited
Nando’s Chickenland Ltd (Nando’s) of Unit 2 The Exchange, Aylesbury has applied for a licence to put tables and chairs on part of the public realm, owned by AVDC. This will allow the land to be used as a seating area for the consumption of food and alcoholic and non-alcoholic drink by the customers of Nando’s during business opening hours.
Nando’s must obtain all planning permissions and all other consents, licences, permissions, certificates, authorisations and approvals including a Premises Licence.
Heads of terms have been agreed and Nando’s for a Sitting Out Licence. Either party will be able to terminate the Licence on one month’s written notice for any reason. The licence fee is comparable to other fees charged for similar uses in other towns.
Nando’s will have to remove its street furniture if so required by emergency services or contractors working for AVDC or Buckinghamshire County Council. The street furniture will also be cleared away from the licensed area outside of the Licensee’s opening hours. Nando’s will be required to remove the tables and chairs and other property from the licenced area for a specific period of time as required by AVDC on giving not less than four weeks’ notice.
Nando’s will be required to maintain public indemnity insurance with a minimum level of cover of £5 million and will be responsible for keeping the licensed area in a neat and tidy condition.
The Town Centre Manager is in favour of the proposal because it promotes the town centre plan’s vision in ensuring Aylesbury has a vibrant, prosperous town centre.
